WSJ and Loser Pays

The Manhattan Institute’s Walt Olson has an interesting post about tort reform – particularly the idea of implementing as a matter of public policy the “Loser Pays” rule.  This is also the subject of a  Jan. 27 WSJ editorial.  Mr. Olson also picked up on a short post that I recently made concerning this topic.
